[Mall of Shame] Letter-Box Company Didn’t Show Up - Now They have to Pay Up

Once again, nobody showed up to represent the defendent at the last two first instance court hearings out of a total of seven wage lawsuits against shady mall subcontractor openmallmaster GmbH. Two more judgments in default of defence were entered against them.

The subcontractor may well be playing for time. The judge herself speculated that the defendent's lawyer Smiechowski might not have been paid and may have therefore resigned. As yesterday’s default judgments are provisionally enforceable, openmallmaster will be under even more financial pressure from now on: the subcontractor now has to pay an additional 1,789.20 and 4,345.00 euros, respectively, in back wages.

This concludes the first instance court hearings for openmallmaster. The result: five default judgments in favour of the employees who were cheated of their wages and two dismissals. But there will definitely be second instance hearings to come. The subcontractor has already filed an appeal against one of the default judgments.

The hearings concerning three wage lawsuits against the subcontractor Metatec-Fundus GmbH & Co. KG are scheduled for October 28. Up until now, management denied ever having employed these workers. But oddly enough, this very company presented the workers with illegal wage waivers and tried to fob them off with several hundred euros in down payments. Another intriguing question is who will represent Metatec in court – as of now, three lawyers hired by the subcontractor have already resigned.
